The Supreme Court of Nigeria has drawn a clear constitutional line around the jurisdiction of the National Industrial Court, resolving years of uncertainty over the proper forum for employment-related tort claims.
TEMPLARS Partner, Inam Wilson, SAN, formed part of the Amici Curiae (“friends of the court”) to the Supreme Court. Amici Curiae provide specialized knowledge, alternative perspectives, or arguments not raised by the parties involved, often in cases with broad public interest.
In a considered interpretation of Section 254C(1) of the Constitution, the Court rejected an expansive reading that would have channelled all workplace-connected torts into the specialised labour court.
Labour and employment disputes remain within the National Industrial Court’s exclusive remit. Standalone tort claims, including defamation, do not, unless they are inseparably bound to the employment contract.
The ruling restores doctrinal discipline to jurisdictional analysis and brings much-needed clarity to court selection in employment and commercial disputes.
